1] What you CAN NOT post.

You agree, through your use of this service, that you will not use this forum to post any material which is:

What you PROBABLY SHOULD NOT post...
Do not post information that you will regret putting out in public. This site comes up on Google, is cached, and all of that, so be aware of that as you post. 2] Use descriptive subject lines & research your post. This means use the SEARCH.

This reduces the chances of double-posting and it also makes it easier for people to see what they do/don't want to read. Using the search function will identify existing threads on the topic so we do not have multiple threads on the same topic.

3] Keep the focus.

Each forum has a focus on a certain topic. Questions outside the scope of a certain forum will either be moved to the appropriate forum, closed, or simply be deleted. Please post your topic in the most appropriate forum. Users that keep doing this will be warned, then banned.

After all, Hitler was such a wonderfully successful politician, such a benefit to his nation, thanks to his inability to compromise and his love of extremisim, and because of his success he is honoured to this day throughout the world.

    Hey, since the authorities have renamed the Selim pass in Armenia, 'cos the "experts" have decided "Selim" is a personal name, and Turkish to boot, and that a particularly bad Turkish sultan was also named Selim, shouldn't all Armenians named "Muradyan" now change their surnames, since Murad/Murat is also a personal name, and Turkish to boot, and quite a few particularly bad Turkish sultans were named Murat?

      I tried to reasonably disprove your nonsense on ArmeniaFund in the other thread, but I guess once the discussion stopped going your way you decided to stop responding. Let me try again. The ArmeniaFund produces everything at less than 10% of what they cost to build here. The Armenia fund in its totality has raised $250 million dollars. Just for comparison, thats less than 10% of the cost of the North-South Highway and the Iran-Armenia rail. I know you're an expert in all walks of life, but large scale infrastructure projects usually costs in the billions of dollars. For a war torn and disaster stricken nation like Armenia, it usually takes dozens of such projects to rebuild the nation. Meaning tens of billions of dollars. Maybe that should explain to you why these donations don't transform the nation.

      Also, I apologize if I don't put a lot of fate into an opposition led by that parasite Dodi Gago and the cartoonish Raffi to lead us to better days.

      I truly apologize if I cant' take seriously a group of people asking for something sure to bring suffering to the nation just so they can come to power.

      Show me an opposition party in Armenia worth supporting and I'll be the first to support them, because I definitely don't support the one in power, I just recognize the lesser of two evils.

            When millions turned against him in 1968 he summoned (and released from prison) many members of the police who were accused of brutality and violence in Algeria so they could put an end to the protests and political turmoil (but in the metropole against ethnic French this time).

              Why Armenia's Gagik Tsarukyan Will Never Be Georgia's Bidzina Ivanishvili

              The politically active segment of society torments itself with this question: Will Prosperous Armenia Party leader Gagik Tsarukyan (pictured, right) become the Armenian Bidzina Ivanishvili (pictured, left)? First President of the Republic of Armenia Levon Ter-Petrossian, the person behind this puzzle, is convinced that only Tsarukyan could be the Armenian Ivanishvili, and Tsarukyan, it seems, is beginning to seriously believe this. For several days now, his party has been in active consultations with representatives of opposition political parties. After such meetings, the participants say they are discussing how to lift the country from its current poor socioeconomic situation, among which, it seems, the option of regime change is not included.

              However, no matter how much others inoculate Tsarukyan with the idea that he is the Armenian Ivanishvili and no matter how much he believes it, he will never become the Georgian businessman who led his party to power and became the country's prime minister. The reason is not just because Tsarukyan became an oligarch and accumulated his huge capital and property in Armenia, while Georgia's former prime minister accumulated his wealth outside of his homeland. That's secondary: it makes no difference whether resources accumulated abroad or at home are invested in the task of improving and changing the situation through revolution in your own country. And if the problem is that, as a consequence of the activities of the revolution, immunity of your property and the security of capital you have inside the country are subjected to risk, well this problem can always be temporarily resolved by exporting your capital, which, by the way, is not foreign to Tsarukyan. In reality, there are much more deep-seated reasons and factors that will never allow Tsarukyan to become a new Ivanishvili.

              1. The Prosperous Armenia Party (BHK) was formed and established not to be an opposition party. This party during its short-term life has never been an opposition party, and it's no coincidence that even being swept up in the "winds of Ivanishvili" the leader of this party doesn't dare call his party opposition. The most important task this party can fulfill is being a part of government, perhaps by constantly increasing its share of the government pie, eventually gaining complete power. But that will be not a qualitatively new government, but a modified version of the old, where only the actors change. It's never possible to effect change in the system this way. Whereas Ivanishvili came down to the square — with the goal of a purely qualitative regime change. The movement he led was developed and established as a radical opposition force, the main resource of which was the broad confidence and support of the public.

              2. Ivanishvili didn't turn his party into a comfortable crib for small- and medium-sized oligarchs. Meanwhile, Tsarukyan purposefully turned his party into such a cozy corner, which is a testament not of politically ambitious forces, but a platform from where, by securing entry and exit into power, they can ensure their business. This flexible and anti-ideological posse at most can solve the issue of buying votes for the BHK during elections. They see neither themselves nor the BHK in the role of reformers, much less as revolutionaries. And the deeper this element is seated in BHK's ship, the more constrained is the captain, who cannot come out against "The Ninth Wave" with such boatswains and mariners for the simple reason that in the real or even perceived likelihood of sinking, they will be the first to jump ship and attack the party and its leader from behind.

              3. Ivanishvili didn't participate in the parliamentary elections by making grandiloquent statements about fair and transparent elections, then on par with the ruling party, in parallel and publicly, buying votes. He didn't act this way not because he had posed a problem of using the votes he received in transactions for portfolios with the ruling power, but to make the citizen responsible for and in charge of his own voice, to make him feel the value of his civil and human dignity. Ivanishvili the day before the parliamentary election didn't make a statement about relentlessly fighting against electoral fraud and rigging and then after the elections, despite considering them to be fraudulent, refusing not to acknowledge the election results and appeal.

              4. Ahead of the elections, Ivanishvili didn't think about the dilemma of being nominated or not, that is, of a battle against the real holder of power, the president and his team, then refuse to participate in the elections and defending any other candidate. This way, Ivanishvili didn't create all the conditions for the reproduction of power and to make the electoral process practically uncontrollable.

              5. It's hard to imagine that Ivanishvili could shrink regime change and lower it to the level of simply changing the prime minister by playing house with the public and by persuading that the sole person responsible for the current catastrophic socioeconomic situation is the individual in the prime minister's seat. Meanwhile, Tsarukyan's party is trying to convince us that needed for that is no more and no less than a political and public consolidation and by introducing a new, alternative socioeconomic and political agenda. Basically, the agenda and the consolidation of the public are needed only for the "dear president" to be forced to replace the prime minister. In other words, this is called not only the ostrich effect, but also the disintegration of political and public energy and potential, while legitimizing the Republican Party of Armenia administration and the entire political course it has adopted.

              6. Ivanishvili entered politics with specific maximal and minimal programs, which clearly showed how he would enact regime change. He was bolstered also by current president Mikael Sahakahsvili's dignified posture accepting political defeat, which kept the country from unrest and perhaps also from the threat of civil war. Meanwhile, in Armenia, on one hand, there can be no expectation for such a stance from the country's current ruling authorities; on the other hand, what Tsarukyan's minimal and maximal programs are are incomprehensible. Is he in favor of snap elections or smooth and slow actions conditioned by regular elections? does he consider the issue of impeaching the president at all? does he see the way by imposing snap parliamentary elections or through civil disobedience or in all cases in carrying out a calm upheaval through acquiring leverage and prowling government? And perhaps the issue isn't regime change at all? Tsarukyan is initiating public and political consolidation — without clarifying the answer to these key questions. This is a matter of not only pure audacity, but also the lack of the innate attributes of being a charismatic leader and having political skill and experience.

              In light of these palpable differences, a question arises: What is the real purpose of creating from Tsarukyan this image of a national savior? Many, and especially those who throw the bait of finding similarities between Tsarukyan and Ivanishvili, perhaps think of reinventing themselves through him, perhaps also about turning him into an instrument. But the experience of previous years shows that usually the complete opposite occurs. Tsarukyan's image has become that distorted skating rink where those same characters continuously stumble in performing various unsuccessful political toe loop and axel jumps.

              After such meetings, the participants say they are discussing how to lift the country from its current poor socioeconomic situation, among which, it seems, the option of regime change is not included.

                Here is an interesting report about a court decision on former PM Hrand Bagratian (LTP's presidency) as being a plagiarist and stealing Manya Hakobyan's work of education and science reforms in Armenia and presenting it as his own.
                This guy reigned on turning soviet Armenian economy into dust and was a candidate against Serj Sargsian in past election. This bastard is a member of HAK coalition now. This is one of the prominent opposition members, one big shot in "golden Four" that has put an agenda of resignation of current PM Sargsian. His ambitions are at this post now.

                Այսպիսով՝ ֆիզմաթ գիտությունների թեկնածու Մանյա Հակոբյանը դատարանում հաղթել է Ազգային ժողովի ՀԱԿ խմբակցության պատգամավոր, տնտեսագիտության դոկտոր Հրանտ Բագրատյանին և ՀՀ ԳԱԱ օրգանական և դեղագործական քիմիայի ԳՏԿ-ի ավագ գիտաշխատող Հարություն Կարապետյանին:

                Մ. Հակոբյանի պաշտպան Սեդրակ Ասատրյանը Aysor.am-ի թղթակցի հետ զրույցում ասել է, որ իր համար կանխատեսելի էր գործի նման ելքը, իսկ վճիռը արդեն կամովին կատարվել է:

                Aysor.am-ը ավելի վաղ անդրադարձել է այս գործին: 2011 թ. օգոստոսի 7-ին «Պահանջում ենք գիտության ֆինանսավորման ավելացում» ֆեյսբուքյան էջում հրապարակվել է «ՀՀ գիտության ոլորտի համակարգային բարեփոխումների ծրագիրը»՝ Հ. Բագրատյանի և Հ. Կարապետյանի ստորագրությամբ, որից հետո Մ. Հակոբյանը հայտարարել է, որ այդ ծրագիրը գողացված է և իրական հեղինակը ինքն է:

                Մ. Հակոբյանը հայց է ներկայացրել դատարան՝ հեղինակային իրավունքների պաշտպանության, խախտված իրավունքների վերականգնման և այլ պահանջներով:

                Երևան քաղաքի Արաբկիր և Քանաքեռ-Զեյթուն վարչական շրջանների ընդհանուր իրավասության առաջին ատյանի դատարանին հայցվորի ներկայացուցիչը հայտնել է, որ հայցվոր Մանյա (Մանե) Հակոբյանը գիտնական է: 1990-ականներից 2011 թվականների ընթացքում Մանյա Հակոբյանն աշխատել և ստեղծագործել է, ստեղծել է մտավոր գործունեության արժեք` «ՀՀ գիտության և կրթության ոլորտների համակարգային վերափոխման և կայուն զարգացման ծրագիր» ստեղծագործությունը:

                Ծրագիրը ունեցել է մեծ պրակտիկ և գիտական ներուժ, ինչպես նաև համազգային օգտակարություն, ուստի հեղինակը որոշել է այն առաջարկել Հայաստանի քաղաքական ուժերին: Վերջիններիս ծրագիրը ներկայացվել է 2003-2009 թվականներին, քննարկվել է տարբեր շրջանակներում: Մանյա Հակոբյանը ծրագիրը նաև ներկայացրել է ՀԱԿ քաղաքական ուժին, քննարկել այն վերջինիս հանձնաժողովում, սակայն զգալով, որ իր ծրագիրը յուրացվում է, Մանյա Հակոբյանը ձեռնարկել է իր իրավունքները պաշտպանելուն ուղղված քայլեր: Սակայն դրանք չեն ունեցել անհրաժեշտ արդյունքները: Մանյա Հակոբյանը 30.04.2010 թվականին գրանցել է իր ստեղծագործությունը ՙՀայհեղինակ՚ հեղինակային իրավունքների պաշտպանության ՀԿ-ում, ինչի համար ստացել է նաև հավաստագիր:

                Պատասխանողներ Հրանտ Բագրատյանը և Հարություն Կարապետյանը յուրացրել են Մանյա Հակոբյանի ծրագրի գիտության բաժինը՝ անբարեխիղճ արտատպել են ծրագիրը, իրական հեղինակին չեն հիշատակել, ստեղծագործությունը ներկայացրել են իրենց անվան ներքո, հրապարակել են զանգվածայնորեն, գործել են առանց հեղինակի թույլտվության և նրան վարձատրելու: Պատասխանողները խախտել են Մանյա Հակոբյանի հեղինակային իրավունքները, որովհետև անբարեխղճորեն արտատպել են նրա ստեղծագործությունը հանդիսացող «ՀՀ գիտության ոլորտի համակարգային վերափոխման և կայուն զարգացման ծրագիրը»:

                Մանյա Հակոբյանի ծրագիրը պաշտպանվում է հեղինակային իրավունքով, որովհետև այն հանդիսանում է ինքնուրույն ստեղծագործական աշխատանքի յուրօրինակ արդյունք` արտահայտված օբյեկտիվ ձևով:

                Պատասխանողների կողմից 2011 թվականի օգոստոսի 7-ին Facebook սոցիալական ցանցի «Պահանջում ենք գիտության ֆինանսավորման ավելացում» էջում, որը հանրամատչելի էջ է և ընթերցվում է առնվազն 4.400 քաղաքացու կողմից, վերջիններս հրապարակել են «Նախագիծ ՀՀ գիտության ոլորտի համակարգային բարեփոխումների ծրագիր» վերտառությամբ գրագողություն` Մանյա Հակոբյանի աղավաղած ծրագիրը` ՙհեղինակներ` Հրանտ Բագրատյան և Հարություն Կարապետյան՚ ստորագրությամբ ծրագրի ներքևում:

                Մանյա Հակոբյանի և նշված ծրագրի ուսումնասիրությունը վկայում է, որ թե առաջինում, թե երկրորդում խոսքը գիտության և կրթության ոլորտի քաղաքականության մասին է: Պատասխանողների ծրագրի տեքստը համարյա ամբողջությամբ կրկնում է Մանյա Հակոբյանի ծրագրի տեքստը: Կան որոշ «փոփոխություններ», «ավելացումներ», կամ ուղղակիորեն նախադասությունները փոխված են տեղերով:

                Մանյա Հակոբյանի ծրագիրը բաղկացած է բուն ծրագրից` 15 կետով, և «Ծրագրի իրականացման արժեքը և ֆինանսավորման աղբյուրները» ծրագրի մասը կազմող գլխից:

                Պատասխանողների նախագիծը բաղկացած է 21 կետերից, որոնցից 15-ը լիովին համապատասխանում են Մանյա Հակոբյանի «Ծրագրին»:

                Այսպիսով` ի թիվս այլոց` կրկնօրինակված է հայցվորի նախաբանը պատասխանողի տեքստում, պատասխանողների նախագծի 1-ին կետի վերնագիրը՝ ՙՀՀ գիտության ոլորտում իրականացնել առկա գիտական թեմաների «գույքագրում» և անցնել գիտահետազոտական աշխատանքների բացառապես «թեմատիկ ֆինանսավորման», առաջնությունը տալով մրցունակ գիտական արդյունքներին՚» և ամբողջ կետը կրկնում է Մանյա Հակոբյանի Ծրագրի 2-րդ կետի միտքը և 1-ին ենթակետը, իսկ պատասխանողների նախագծի 2-րդ, 3-րդ, 4-րդ կետերը այդ նույն «Ծրագրի» 2-րդ կետի շարունակությունն են:

                Դատարանը իր պատճառաբանություններում հայտնել է, որ պատասխանողի ներկայացուցչի այն պնդումը, թե հայցվորը պետք է ապացուցի, որ ծրագիրը «Հայհեղինակ» ՀԿ է ներկայացվել 30.04.2010 թվականին, ապա այդ հանգամանքը ապացուցվում է «Հայհեղինակ» ՀԿ-ի կողմից 03.09.2012 թվականին տրված գրությամբ, որով «Հայհեղինակ» ՀԿ-ն իրազեկել է, թե իրեն որ ամսաթվին ինչ է տրամադրվել ի պահ:

                Ինչ վերաբերվում է պատասխանողի ներկայացուցչի առարկություններում բերված պատճառաբությանն, այն մասին, որ վերը նշված էլեկտրոնային նամակներով չի հաստատվում և ապացուցվում ծրագիրը հայցվորի կողմից ստեղծված լինելու հանգանմանքը, այլ այդ նամակներով հիմնավորվում է, որ ըստ էության քննարկվել է երկու ծրագիր` մեկը` մշակված ՀԱԿ կրթության և գիտության հանձնաժողովի կողմից, մյուսը` տրամադրված Հարություն Կարապետյանի կողմից, որում Հրանտ Բագրատյանի կողմից կատարվել են որոշակի փոփոխություններ, ապա նշվածը հայցը մերժելու հիմք հանդիսանալ չի կարող, նկատի ունենալով, որ դատարանում գործի քննության ընթացքում պարզվեց, որ Հարություն Կարապետյանի կողմից Հրանտ Բագրատյանին ուղարկված ծրագրի հեղինակը եղել է Մանյա Հակոբյանը /այդ մասին վերջինս բազմիցս հայտնել է իր նամակներում` ուղղված Հրանտ Բագրատյանին/:

                Այսպես դատական նիստի ընթացքում հայցվորի ներկայացուցիչ Ս. Ասատրյանը ցույց է տվել Մանյա Հակոբյանի կողմից Հարություն Կարապետյանին ուղարկված 25.05.2010թ. էլետկրոնային նամակին կից ֆայլը, որը բեռնվել է ինտերնետից: Նշված ֆայլի հետազոտությամբ պարզվեց, որ որպես ֆայլի «Գիտություն-1»-ի հեղինակ նշված էր «Մանե»:

                Ցույց է տրվել նաև Հարություն Կարապետյանի կողմից Հրանտ Բագրատյանին ուղարկված էլեկտրոնային նամակին կից ֆայլը, որը նույնպես բեռնվել է ինտերնետից: Էլեկտրոնային նամակում նշված էր. «Հարգելի պարոն Բագրատյան. Ուղարկում եմ գիտության ոլորտում նախատեսվող բարեփոխումների միջոցառումների ծրագիրը, որը քննարկվել է Մանեի և Վլադիմիր Հարությունյանի հետ ...»: Նշված ֆայլի անունը թեև փոխվել էր, սակայն այդտեղ նույնպես որպես հեղինակ նշված էր «Գիտություն-1 Մանե»:

                Պատասխանող Հարություն Կարապետյանը, ինչպես էլեկտրոնային նամակագրությամբ, այնպես էլ դատարանում հայտնել է, որ ինքն իրեն չի համարել և չի համարում ՀԱԿ ծրագրի համահեղինակ, քանի որ չի մասնակցել ՀԱԿ-ի քննարկումներին... Երբ հարց է առաջացել, թե ում անունը պետք է գրվի ՀԱԿ-ի ծրագրի տակ, ինքը զանգահարել և հայտնել է Հրանտ Բագրատյանին, որ իր անունը չնշվի, իսկ գործի քննության ժամանակ վերջինս չվիճարկեց և դատարանին որևէ ապացույց չներկայացրեց, որ նշված «Ծրագիրը» իր ծրագիրն է:

                Բացի այդ, դարձյալ, ըստ կողմերի նամակագրության` Մ. Հակոբյանը համաձայնվել է, որ ստեղծագործությունը համարվի համահեղինակություն /տես 24.07.2010թ. հայցվորի նամակը ուղղված Հ.Բագրատյանին/»...Եթե ծրագիրը պահպաներ այս իմ ներկայացրած տեսքը, որին ավելացվեր Ձեր «Կրթության» մասը՚:

                Դրան հաջորդել է Մանյա (Մանե) Հակոբյանի և Հրանտ Բագրատյանի նամակագրական բանավեճը, որտեղ Մանյա (Մանե) Հակոբյանը պահանջել է հանել իր ծրագիրը և չընդգրկել իր ծրագրի կետերը, դրանք չաղավաղել, որին, ի պատասխան, Հրանտ Բագրատյանը առարկել է միայն մի փոքր հատվածի շուրջ «Գիտությունը նոր գիտելիք է գեներացնում...» և հիշեցրել է, որ կրթության հատվածն է իրենը: Բացի այդ 31.08.2010թ. ժամը 9:14-ին Մանյա Հակոբյանի` Հրանտ Բագրատյանին ուղղված նամակում վերջինս հայտնել է, որ հանել է իր ծրագիրը քննարկումից, իսկ նույն օրվա ժամը 10:03-ի էլեկտրոնային նամակի վերջինս հայտնել է. «Հարգելի պրն. Բագրատյան, այս տհաճ իրավիճակից դուրս գալու ծայրահեղ տարբերակը առանձին-առանձին «Ծրագրերի» ներկայացնելն է, որից էլ ամեն ինչ պարզ կդառնա բոլորին»:

                Նման պայմաններում դատարանը գտնում է, որ խոսք անգամ չի կարող լինել համահեղինակության մասին. պատասխանողները խնդրո առարկա ծրագրի համահեղինակներ չեն եղել և այդ պահանջով դատարան չեն դիմել:
                Անդրադառնալով հակընդդեմ հայցադիմումին, դատարանը գտնում է, որ սկզբնական հայցապահանջի բավարարման պայմաններում, հակընդդեմ հայցադիմումը ենթակա է մերժման վերը նշված պատճառաբանություններով:

                Դատարանը վճռել է պարտավորեցնել Հրանտ Բագրատյանին և Հարություն Կարապետյանին հրապարակումից հանել առանց հայցվոր Մանյա Հակոբյանի թույլտվության նրա ստեղծագործության ցանկացած եղանակով անբարեխիղճ օգտագործմամբ հրապարակումները, այն է` հրապարակումից հանել «Facebook»–ում հրատարակված Հրանտ Բագրատյանի և Հարություն Կարապետյանի հեղինակությամբ ծրագրի 1-ին, 2-րդ, 3-րդ և 5-րդ պարբերությունները, որոնք համընկնում են Մանյա Հակոբյանի «Հետք Online-ում հրապարակված ծրագրի 6-րդ, 7-րդ, 8-րդ, 10-րդ, 11-րդ պարբերությունների հետ, ինչպես նաև Մանյա Հակոբյանի կողմից «Հայհեղինակ» ՀԿ-ում ի պահ հանձնված ծրագրերի տարբերակների և «Facebook»–ում հրատարակված ծրագրի նույնական մասերը` համաձայն ՀՀ Էկոնոմիկայի նախարարության աշխատակազմի մտավոր սեփականության գործակալության 21.01.2013 թվականին տրված դատահեղինակային եզրակացության` նշված կարմիր գույնով:

                Պատասխանողներ Հրանտ Բագրատյանի և Հարություն Կարապետյանի միջոցների հաշվին «Հայաստանի Հանրապետություն» օրաթերթում հրապարակել սույն դատական ակտի վճռեց մասն ամբողջությամբ:

                Արգելել պատասխանողներ Հրանտ Բագրատյանին և Հարություն Կարապետյանին հայցվոր Մանյա Հակոբյանի ստեղծագործության տարածումն, աղավաղումն ու փոփոխությունը:

                Դատարանը գտնում է, որ որպես փաստաբանի խելամիտ վարձատրության ողջամիտ գումար պետք է սահմանել 1 000 000 ՀՀ դրամը, որը և պետք է համապարտությամբ բռնագանձել պատասխանողներից հօգուտ հայցվորի:

                Համապարտության կարգով պատասխանողներ Հրանտ Բագրատյանից և Հարություն Կարապետյանից հօգուտ հայցվոր Մանյա Հակոբյանի բռնագանձել նախապես վճարված պետական տուրքի գումարը 24 000 ՀՀ դրամի չափով:

                Հրանտ Բագրատյանի հակընդդեմ հայցն ընդդեմ Մանյա Հակոբյանի, երրորդ անձ` Հարություն Կարապետյանի` հեղինակային իրավունքների պաշտպանության պահանջի վերաբերյալ` մերժել:

                Վերաքննիչ դատարանը մերժել է Հ. Բագրատյանի և Հ. Կարապետյանի բողոքը և օրինական ուժի մեջ թողել դատավճիռը:

                    Armenia’s Constitutional Court has just recognized a number of provisions of the new funded pension scheme law as conflicting with the country’s Constitution, and hence invalid. –0—





                    Great day, even though its a temporary victory, its good to see some semblance of democracy, and much more importantly clear signs of public engagement and progress.
