NEW CONSTITUTION – THE LESSER OF EVILS
The problem of the independence of the juridical power has not been solved yet, representatives of the parliamentary opposition consider.
Independent deputy Manuk Gasparyan supposes that despite all the amendments introduced in the organic law of the country it still preserved its negative points. “The fact that the Justice Council will not be appointed by the President will certainly give a positive impulse to the reform. However I do not agree with the clause referring to the appointment of judges. Though I do not know myself what would be more correct here. If here is no political explanation there should be human approach of an ordinary citizen”, he says.
As an ordinary citizen Manuk Gasparyan suggests the following system of juridical power. “If the President preserves the right of appointing judges, the courts will not be just in respect to the people. There are a lot of circumstances essential for putting the system into order. The judges should receive proper wages. In this case they will not covet the others’ property. Besides, all this should start from the student years: one should not pay money to enter the juridical department, one should not pay money to pass the exams. If all this continues we will not have any radical changes in the juridical system within the next 10-15 years”, he says.
Justice faction secretary Victor Dallakyan more vividly describes the motives of distrust to the constitutional reform as regards the juridical system. In his opinion, the problem of the juridical power in Armenia will be solved under the condition that the Justice Council is the structure to take decisions. “According to coalition’s draft the Justice Council presents conclusions only while the President takes the decision. It is in his power to admit or reject the conclusion”, he notes.
In Dallakyan’s opinion the problem lies not in the Constitution but in the tradition of its violation. Manuk Gasparyan considers that with all the faults of the reviewed constitution it is the lesser of the evils.
