    world and the purposes for which it was enacted are no longer with
    us," stated Armenian FM Vartan Oskanian addressing the OSCE Council
    of FMs session in Ljubljana, reported the Press Service of the MFA
    of Armenia. Yet the principles, norms and values of that document
    have endured the test of time, although the vehicles and instruments
    that have articulated and politically promoted and protected those
    fundamental principles of human rights and the rights of people,
    have adapted and changed, he remarked. Or perhaps they have endured
    because they have transformed themselves, he added.

    "After all, the participating states, too, are not what they used
    to be.

    Though still in transition, Armenia, for example, is less fragile,
    less vulnerable, less inexperienced with the ways of an open society.

    Independence is already 14 years old. Our institutions are more
    democratic, our economy more private, our markets more liberal,
    our trade more diversified, our diplomacy unconstrained and free
    to interact with North and South, West and East," the Armenian
    FM said. "Of course, our transition is not complete," Oskanian
    added. "But, frankly, everywhere in the OSCE region, economies are
    in some stage of transition, the rule of law is a work in progress,
    the movement from citizen rights to human rights still a difficult
    challenge," the Armenian Minister noted.

    We all know these things, Oskanian said. In his words, the essential
    task before them is to make sure the rules, methods and practices of
    the OSCE adapt sufficiently and appropriately to remain effective and
    beneficial and not exacerbate the inevitably uneven power and influence
    among this group of 55 - where San Marino, Monaco and Liechtenstein
    are members together with the United States, the Russian Federation
    and the EU. "It was in a search for such prudent adaptation that in
    Sofia, at the last Ministerial, we opted to seek the assessments and
    recommendations of a Panel of Eminent Persons.

    Indeed, seven wise persons conferred and saw the need for
    modification," Mr.

    Oskanian stated. "Armenia remains ready to work further, to participate
    fully and try to make the OSCE as an organization become more
    resilient, more effective and more capable to meet the challenges
    ahead of us: terrorism, the consolidation of democracy, respect
    for human rights, the expansion of economic opportunity, managing
    migration in all its manifestations, the resolution of existing and
    emerging conflicts and the reconstruction and rehabilitation of areas
    affected by those conflicts.

    These challenges can only be met if all Participating States avoid
    seeing the world through the narrow prism of their own domestic
    political imperatives," the Armenian FM stated.

    Speaking of the future of the Helsinki Final Act V. Oskanian remarked
    that the integrity of the Helsinki Final Act will be protected and
    preserved only if the integrality of the document is respected. "The
    Helsinki Decalogue is just like the Ten Commandments. Their
    functionality, appropriateness and efficacy depend on a unified
    approach, not an expedient and selective one," he said. "That is why
    when the right of self-determination of the people of Nagorno Karabakh
    is callously dismissed, we insist on reminding the world that this
    is not a conflict between principles, this is a people's struggle
    for self-determination. Since the conflict began, international
    developments and self-determination processes in different parts of
    the world have led to fundamental changes in international thinking
    on this issue. Relationships between states - new and old - are
    evolving. We have witnessed East Timor's independence through a
    referendum and the signing of an agreement in Sudan concluding a
    decades-old conflict on the basis of a referendum to be held in one
    part of the country. Today there are serious deliberations about
    Kosovo's future status. Among political, legal and academic experts,
    there is a growing awareness of the possibility and reality of
    recognizing the right of self-determination in certain circumstances,"
    the Armenian FM emphasized.

    In his words, those circumstances nearly exactly describe NK today.

    Azerbaijan has no control whatsoever over Karabakh, which has achieved
    the attributes of complete sovereignty in the last 15 years, Oskanian
    said. "In addition to the duration and depth of its self-determination,
    Nagorno Karabakh's situation is further reinforced and made complete
    by the following facts. First, it seceded legally, according to the
    laws of the day. Second, the territory in question has never been
    within the jurisdiction of independent Azerbaijan. Third, Azerbaijan,
    in perpetrating violence against people that it considered its own
    citizens, has lost the moral right to custody over those people. And,
    finally, there is the de facto political reality of Nagorno Karabakh's
    proven ability to hold elections, govern its people, protect
    its borders and conduct international relations. In other words,
    actually in Helsinki language, they are exercising their right to
    "without external interference, pursue as they wish their political,
    economic, social and cultural development." This is their right. This
    was the world's promise to the peoples who lived on the other side of
    the Iron Curtain, and some of whom, like us, are sitting around this
    table, today. The people of Nagorno Karabakh are no less deserving
    of that promise," V. Oskanian summed up.

    In conclusion, Mr. Oskanian expressed Armenia's appreciation for the
    work done by the Slovenian Chairmanship. "The proof of Slovenia's
    hospitality and generosity is evident throughout this Ministerial
    Council. We congratulate Belgium for its assuming the Chairmanship
    next," the Armenian FM said.

    It should be noted that during his visit to Ljubljana the Armenian FM
    had a number of bilateral meetings. December 4 evening he met with
    Daniel Fried, US Assistant Secretary of State, Bureau of European
    and Eurasian Affairs.

    Today V. Oskanian had meetings with Luxembourg leader Jean Asselborn,
    Romanian FM Mihai-Razvan Ungureanu, OSCE Chairman-in-Office, Slovenian
    FM Dimitrij Rupel. December 5-6 the Armenian FM is scheduled to meet
    with Council of Europe Secretary General Terry Davis, OSCE Secretary
    General Marc Perrin de Brichambaut, Ukrainian FM Boris Tarasyuk.

      Participants of OSCE session in Ljubljana, Slovenia, adopted
      a statement, which points out to the "progress achieved on the
      sidelines of Prague Process." "The sides have to trade negotiations for
      decisions. We call on Armenian and Azerbaijani presidents to use this
      promising break to get essential achievement in regulation process,"
      the statement reads.

      OSCE chairman-in-office Dimitri Rupel stated that the sides in Karabakh
      conflict are on the brink of settlement. "Stability in Azerbaijan will
      create real chances for regulation of the frozen conflict," Rupel said.

      Regarding Kosovo conflict OSCE chairman-in-office said that this issue
      should be settled as soon as possible and urged Belgium, holder of
      OSCE chairmanship in 2006, to deepen dialogue between Georgia and
      Northern Ossetia.

      GUAM - new international organization

      CIS member states Georgia, Ukraine, Azerbaijan and Moldova, which
      formed regional GUAM organization in 1997, took a decision in
      Ljubljana to evolve into an international organization. Azerbaijani
      foreign minister Elmar Mamediarov said that the headquarters of the
      organization, which is widely viewed as a balance weight for the CIS,
      will probably be in Kiev.

          Foreign Minister Vartan Oskanian echoed on Thursday the international community’s optimism about prospects for the resolution of the Nagorno-Karabakh conflict, citing an unusually positive statement by the Organization for Security and Cooperation in Europe.

          The statement adopted on Tuesday by the foreign ministers of the OSCE member states, including Armenia and Azerbaijan, confirmed that the conflicting parties have made major headway towards a peaceful settlement during their so-called “Prague process” of negotiations. “We believe that the Parties are now poised to make the transition from negotiation to decision and that the are serious benefits within reach for all,” it said.

          “We encourage the Presidents of Armenia and Azerbaijan to use the current promising window of opportunity in order to attain within the coming year significant achievements in the settlement of the conflict,” the statement added, heightening expectations from the upcoming meeting of Ilham Aliev and Robert Kocharian.

          Speaking to RFE/RL from Brussels, Oskanian stressed the fact that it was the first time that the OSCE’s governing Ministerial Council expressed its satisfaction with the peace process. He noted that its previous statements on Karabakh usually regretted the lack of progress in the process mediated by the OSCE Minsk Group.

          Oskanian said he and Azerbaijani Foreign Minister Elmar Mammadyarov approved the text of the brief statement beforehand, during their weekend “informal” meeting in Slovenia. The meeting took place in the presence of the Minsk Group’s U.S., Russian and French co-chairs.

            • Referendum for Karabakh?: Internationals see vote as possible factor for settlement

              On December 10, 1991, the population of Nagorno-Karabakh, under fire from Azeri forces, turned out to vote despite possible dangers for a referendum on NKR’s independence.



              Several dozen voters were heavily wounded, and ten people lost their lives on their way to the polling stations. Still, the vote was taken, and, 99.89 percent of the number of voters who took part in the ballot approved an independent political status of the already proclaimed Nagorno-Karabakh Republic.

              Today, however, what the Azeri army failed to do is now being successfully managed by the international community: It does not recognize the results of the referendum.

              A delegation of the International Crisis Group on Conflict Prevention (ICGCP) led by its vice-president Alain Deletroz raised the issue in September, and the debate grows more pertinent as international bodies are now talking about a referendum for resolving the Karabakh “problem.”

              “The world will not recognize the results of the referendum and a new referendum will have to be held to determine the status of Nagorno-Karabakh,” Deletroz said. “But it may take place only within 10-15 years and after Armenia withdraws from the occupied Azeri territories.”

              Earlier, on July 15, during a press conference of the OSCE Minsk Group cochairmen, the Russian negotiator Yuri Merzlyakov was asked about a the presence of a point regarding the holding of a referendum in the “Working Document” being drafted. Merzlyakov would said he could not comment on the report, but did not deny that a referendum might be part of the OSCE proposal concerning NKR.

              (NKR President Arkadi Ghukasyan commented on the recent talk of the Karabakh referendum saying: “Our people have already held a referendum on the matter [meaning the referendum in 1991], but we can hold another one if necessary.”)

              “Ignoring the results of the December 10, 1991 referendum is an international cynicism and a slap in the face of all legal provisions,” says political analyst, lecturer at the Department of Philosophy and Sociology, Yerevan State University Alexander Manasyan. “The diplomatic value of this event is that it passed in a characteristic demographical situation and objectively reflected the sentiments of the people of Nagorno-Karabakh.”

              Former foreign affairs advisor to Azerbaijan’s President Heydar Aliyev, Vafa Guluzade (and former translator for Leonid Brezhnev) notes in this regard: “The issue about the status of Nagorno-Karabakh is immediately connected with the Constitution of the Azerbaijani Republic where Azerbaijan is determined as a unitary state. It is obvious that in this case we may deal already with constitutional amendments, and this is a subject of a nationwide vote on Azerbaijan.”

              However, in the opinion of the Armenian political analyst, Guluzade is obviously being cunning: “One should not forget that by the moment of the adoption of the Constitutional Act on Azerbaijan’s state independence on October 18, 1991, the Nagorno-Karabakh Republic had already existed: it was proclaimed on September 2, 1991. Besides this, one should note that this political event took place in full correspondence with the points of the USSR Law ‘On the Order of Solving Issues Connected with the Quitting of a Union Republic from the USSR’ adopted on April 3, 1990.”

              Article 3 of this law reads: “In a Union republic that includes autonomous republics, autonomous regions and autonomous areas, a referendum is held separately for each autonomy. The people of autonomous republics and autonomous formations reserve the right to an independent decision as to whether they stay in the USSR or in quitting the Union republic…”

              “Azerbaijan that declared independence in correspondence with the provisions of this law in fact tries to fully stop the effect of the same law in relation to the Nagorno-Karabakh Autonomous Region,” says Manasyan. “Moreover, if independent Azerbaijan officially rejects its Soviet heritage, then it automatically gives up Nagorno-Karabakh and Nakhijevan, which were part of Soviet Azerbaijan only during the period of the USSR’s existence.”

              An excerpt from the text of the Constitutional Act “On the State Independence of the Azerbaijani Republic” reads: “The Azerbaijani Republic is a legal successor of the Azerbaijani Republic that existed from May 28, 1918 to April 28, 1920.”

              (Unlike the First Armenian Republic, Azerbaijan was not recognized by the League of Nations and did not become an entity of international law because of its undetermined borders and aggressive policies. At least that was the motivation of the League’s official rejection of Azerbaijan’s application to become its member…)

              • ON "ROAD MAP FOR KARABAKH CONFLICT SETTLEMENT": A "UNIFIED STATE" SCENARIO

                In a recent interview to REGNUM the advisor of the Armenian defense
                minister, doctor of political sciences Hayk Kotanjyan made public his
                scenario of how to combine the principles of territorial integrity
                and self-determination as applied to the Karabakh peace process. The
                interview was supplemented by the author's view of the road map
                carrying on polemics with the reports of the International Crisis
                Group. Following this controversial response we have asked the author
                to give some explanations.

                REGNUM: Your opponents conclude that you were granted an information
                leak on the Minsk Group agreements. Is this true?

                This is not true. In my interview I give some of my ideas and
                conflict solving schemes in academic polemics with the findings of
                my colleagues from such an authoritative analytical organization as
                the International Crisis Group (ICG). As an expert in the sphere,
                I agree and disagree with a number of judgements and proposals by my
                ICG colleagues. My analysis is an attempt to draw the attention of
                professionals as well as to reevaluate the proposals made by the OSCE
                Minsk Group in 1997 and 1998 on the status of Nagorno Karabakh and on
                the corridor between Armenia and Nagorno Karabakh. You can find open
                sources information on the OSCE MG Co-chairmanship 1997-1998 documents
                in the internet (see: http://vn.kazimirov.ru/docs.htm). Concerning the
                "leak" fantasies and personal offences -- they, obviously, go beyond
                the framework of an academic dispute. But still, my belief is that
                professional polemic is very topical and essential.

                REGNUM: What is the objective of making public the "Road Map for
                Karabakh Peace Settlement"?

                The objective is to unfold constructive professional polemics with
                the Draft Road Map for Karabakh Peace Settlement by the International
                Crisis Group. To be a mouthpiece for giving the conflicting parties
                my vision of the truth about the limits of harmonization of their
                interests and to outline for experts as well as people in Armenia
                and Azerbaijan the possibilities for overcoming confrontations in
                their relations.

                REGNUM: In the neighbor country some hotheads have called your article
                "a plan of Azerbaijan's capitulation," while those in Armenia "a
                document of the nation's treason." So, the opponents are criticizing
                some document entitled "Road Map for Karabakh Peace Settlement." How
                would you comment on this?

                My article is surely not a document. It is an author's work, an
                academic essay containing no political or legal imperatives for its
                compulsory and comprehensive implementation. The publication and
                professional discussion of my analysis may be helpful in making more
                expansive and flexible the intellectual resources of the international
                expert community for their exerting consulting influence on the course
                of the consultative and negotiating process for the benefit of the
                conflicting parties. In this very light I welcome the publication
                of the analytical response from Armenia and Nagorno Karabakh as an
                attempt to critically review the "Road Map" article. It might be
                useful if Azeri experts also got involved in the dispute.

                REGNUM: Does you "road map" envisage reunification of Nagorno Karabakh
                with Armenia?

                Yes, provided that Azerbaijan rejects effective consultations under
                the OSCE MG aegis and fails to start negotiations with Nagorno Karabakh
                Republic and Republic of Armenia for peacefully resolving the Karabakh
                conflict. Then NKR as a lawfully formed state may start talks with
                Republic of Armenia for holding a referendum on "a unified state."

                  Vahram Atanesian: Karabakh with its potential is a part of South Caucasian security system

                  As opposed to the former Armenian authorities that tried to "hide" behind Nagorno Karabakh in the post-ceasefire talks, trying to convince the world community that the conflict is between Azerbaijan and Nagorno Karabakh, the present-day Armenian authorities take too much responsibility and push Karabakh out of the negotiation process.

                  In effect, whole methodology of Karabakh issue has changed, and the international community views Armenia and Azerbaijan as the main actors. The fact that the OSCE Minsk Group cochairmen visit the region these days but do not stop over in Stepanakert resorting to an unserious subterfuge of "lack of time" testifies to their approach to the conflict. NK President Arkady Ghukasian will receive the new package of regulation proposals from the cochairmen in Yerevan. After negotiations with Armenian authorities, the mediators will head for Baku.

                  Azg daily turned to Vahram Atanesian, chairman of the Commission on Foreign Affairs of NK National Assembly, asking him to assess the cochairmen's refusal to visit Karabakh. "If we take a profound look at the issue we'll see that the mediators' visit to Stepanakert principally would change nothing as there is no difference whether they hand the package to NK officials in Yerevan or Stepanakert," Atanesian said.

                  At the get-together of OSCE foreign ministers in Ljubljana on December 5-6 European and US officials noted that there is currently a break in Karabakh regulation process and the sides signal about their readiness. The sides are optimistic as there is no election either in Armenia or Azerbaijan in 2006.

                  Atanesian thinks that regulation will not be reached in 2006. As to the role of NK in talks process, he thinks that the role is unchanged. "NK is an established state in the South Caucasus and with its potential is a part of South Caucasian security system. The mediators and European officials are mistaken if they think that the conflict will be settled only by the good will of Armenia and Azerbaijan."

                  "I have an impression that the cause of the conflict being unsettled so far is not in the hard-line stances of the sides but in discord among the cochairmen. I mean the 3 cochairmen have no clear approach to the conflict regulation. And the countries in chair - USA, France and Russia - have different interests in the region. I think that is the reason why the conflict is unsettled or why there is no wish to put an end to it. I don't mean Armenia, Karabakh and Azerbaijan are ready to compromise. They are certainly not. But the absence of will in the mediators adds to it," Atanesian said.

                  The press release the NK Foreign Ministry disseminated last weekend on occasion of the 14th anniversary of independence referendum read: "No one should cherish illusion: there will be no return to past. Though the world community views NKR today as a de facto established state and an essential factor in regional security, we hear calls to turn back time, to return to past that a generation of young people separates us from. This is the generation that has never seen arbitrariness, discrimination and violence that their parents underwent in Azerbaijan."

                    participation of Stepanakert in the negotiation process, NKR President
                    Arkady Ghukasian told journalists upon completion of the meeting with
                    the OSCE Minsk Group Co-Chairs. At a certain stage of the negotiation
                    process Karabakh's participation will become necessary, he said. "The
                    OSCE MG mediators agree with it, since Nagorno Karabakh has much
                    more issues to settle with Azerbaijan than Armenia does," Ghukasian
                    noted. When commenting on the possibility of conducting a referendum
                    for determination of the status of Nagorno Karabakh Ghukasian said the
                    idea of referendum is admissible. "If Azerbaijan and the international

                    today is to exclude the possibility of hostilities and sign a peaceful
                    agreement," Ghukasian stated.

                    To note, in a conversation with journalists OSCE Minsk Group Russian
                    Co-Chair Yuri Merzlyakov stated that the mediators are going to
                    share "verbal proposals and considerations" on the Karabakh conflict
                    settlement with the Armenian President, reported IA Regnum.

                      Karabakh conflict settlement was considered during the meeting with
                      the OSCE Minsk Group Co-Chairs, NKR President Arkady Ghukasian told
                      journalists in Yerevan upon completion of the meeting with the OSCE
                      MG mediators. "Our approaches have not changed, our position in
                      known. I expressed my concern over the aggressive statements by the
                      Azerbaijani leadership, since they do not contribute to the Nagorno
                      Karabakh conflict settlement process and undermine the efficiency
                      of the talks," the NKR leader stated. He also added that no written
                      proposals were produced by the mediators. "There are only variations on
                      some issues," he noted. "Presently the Presidents and FMs of Armenia
                      and Azerbaijan are trying to find common ground. It means that the
                      negotiation format may change and the issues concerning Nagorno
                      Karabakh will be presented to the parties and mediators. Decision
                      of any issue just as the settlement of the conflict is impossible
                      without our participation," he said.

                      When touching upon temporary inclusion of Stepanakert in the
                      negotiation process the NKR President noted that "Karabakh became
                      a party of the negotiation process long ago, however presently no
                      talks are held within the framework of the Minsk MG." In his words,
                      difficulties emerge when Azerbaijan says it will not negotiate with
                      Karabakh and the mediators can nothing but accept the ultimatum
                      comprehending however that without NKR this problem cannot be
                      resolved. . "I told the mediators that if official Baku really wished
                      to settle the conflict it would hold talks with Karabakh and take steps
                      for creating the atmosphere of mutual trust," NKR President resumed.
