    /PanARMENIAN.Net/ The trial over the case of murder of Armenian
    officer Gurgen Margaryan by Azeri military Ramil Safarov during their
    participation in NATO courses will resume September 27. Armenian MOD
    representative for the murder affair Hayk Demoyan reported that in
    the course of a recurrent session the Hungarian court will hear the
    evidence of second Azeri officer, who participated in the NATO
    courses. Armenian officer Hayk Makuchyan will also address the
    hearing. Hayk Demoyan, Hayk Makuchyan, Gurgen Margaryan's parents and
    lawyer Nazeli Vardanyan will leave for Hungary for participation in
    the trial. In Hayk Demoyan's opinion, the trial scheduled in
    September will not be the last one, as a third judicial and medical
    expert examination is necessary. R. Safarov was recognized compos
    mentis by the first expertise. The conclusion said Safarov has
    committed the murder in cold blood and compos mentis. The second
    expertise results differed from those of the first one: the
    conclusion noted certain weakening of Safarov's state of mind at the
    moment he was committing the crime. By a court resolution the two
    expert groups are scheduled to meet to produce a final conclusion. It
    should be noted that Azeri experts were present at the second
    expertise, however they did not have a right to influence the process
    in any way. In Hayk Demoyan's words, Azeri authorities are trying to
    use the evident protraction of the trial to solve domestic political
    problems. In his opinion, it is not casual for some Azeri politicians
    directly link the intention of Safarov's extradition to Azerbaijan
    with Karabakh settlement. It should be reminded that the Hungarian
    court has prohibited the Azeri party presenting documents and
    materials of propagandistic nature. Hayk Demoyan assured the Armenian
    party holds propagates in Hungary before the beginning of the
    recurrent hearings. In his words, the local Armenian community
    assists it as well. Meetings with Hungarian society members, the
    press continue. Hayk Demoyan said that in his opinion «to avoid
    tragedies of the kind it is necessary to competently struggle against
    them by means of corresponding propaganda and delivering a deserving
    counterblow to the Azeri party," Armenpress reported.

    THE FAMILY OF THE ARMENIAN OFFICER MURDERED IN BUDAPEST TO RECEIVE A
    LAND LOT AS A COMPENSATION

    YEREVAN, July 28. /ARKA/. The RA Government took a decision to render
    help on the part of the government to the family of the Armenian
    Officer Gourgen Margaryan murdered in Budapest. According to RA
    Government's Press Service Department, in regard with this the
    government gave a land lot of 2 thsnd square meters, adjacent to
    "Paros" restaurant ("Lighhouse") on Sebastia street for gratuitous
    use. The lot as a donation will be given to the mother of Margaryan
    Shoushanik Minasyan.
    To remind, on Feb 19, 2004 the Lieutenant of the RA Armed Forces
    Gourgen MArgaryan, who attended English language courses in Budapest
    organized by the national defense of Hungary in the framework of the
    NATO Partnership for Peace Program, was cruelly murdered by means of
    an axe when sleeping by Azerbaijani Officer Ramil Safarov, who was on
    the same courses. The trial on the case of murder of Margaryan is

      The trial of the assassination of Gourgen Margaryan in Hungary has
      been postponed once again till December 15. During the trial the
      Armenian officer who had left for Hungary with Gourgen Margaryan gave
      evidence The testimony of the officer from Lithuania who was absent
      from the trial has also been read. As for the second Azeri officer,
      he was absent from the trial for the third time with the sane excuse
      of being ill.

      The experts who had realized the forensic examination of the
      psychological state of Ramil Safarov were also invited to the
      trial. Taking into account the fact that the conclusion of different
      experts differed from each other, the Court decided to realize double
      examination. The advocate of Ramil Safarov mentioned that the court
      decision will depend on the results of the examination.

      Let us remind you that on February 19, 2004 in Hungary the Azeri
      officer Ramil Safarov murdered the Armenian officer Gourgen
      Margaryan. The officers participated in courses of English in the
      margins of the NATO program "Cooperation for the Sake of Peace".

        Armenian Officer Murderer Trial Put Off Till December 15

        The recurrent court sitting on the case of Azeri officer Ramil Safarov accused of the murder of Armenian officer Gurgen Margarian was held in Budapest yesterday. According to Azeti lawyer Adil Ismaylov, the court decreed to postpone the sitting till December 15. The postponement was caused by the disagreement of the experts on Ramil Safarov's psychological state. The opinion of three Hungarian experts, who were carrying out the examination, differed and the court set another examination. To remind, the previous court sitting was held on May 10, 2005.

        As reported by AzerTage news agency, yesterday's sitting was opened by presiding Judge Anrdas Vaskuti. He read the request of the Armenian attorney to involve an Armenian expert in the examination process. The request was declined over the possible retardation of the process. The letter sent by the Azerbaijani Embassy in Hungary and reporting that witness Anar Aliyev will not give testimony over illness was also read. A witness from Lithuania did not appear either, however his testimony was read. The court heard the evidence by witness from the Armenian part Hayk Manucharian. Then it proceeded to the outcomes of the examination. To remind, the first examination was made immediately after the tragic incident. The second one was carried out later with the participation of Azeri observers. Since the opinion of the two expert groups differed fundamentally the Judge set another examination and declared that the next court sitting is fixed for December 15, 2005.

        Members of the Azerbaijani Embassy, representatives of the Azeri Diaspora, sportsmen and students were present in court. To remind, the trial of Ramil Safarov started last November. He is accused of murder of Armenian officer Gurgen Margarian (February 19, 2004) during NATO English courses in Budapest. The previous court sitting took place on February 8, 2005. Ramil Safarov is accused according to the Article 166.2 of the Hungarian Criminal Code (murder with aggravations) calling for deprivation of liberty with a term of 10-15 years or life imprisonment.

          Ramil Safarov Third Medical Expertise Due Late November

          expertise in late November. A conclusion will be drawn upon
          acquaintance with the expertise outcomes," Safarov's attorney Adil
          Ismaylov stated. According to the lawyer, after the conclusion of the
          medical expertise is received, the trial documents will be submitted
          to court. Ismaylov also said he kept in touch with the client by
          telephone and the officer's state is satisfactory.

          As earlier stated attorney on the case of murder of G. Margaryan,
          member of the International Bar Association Nazeli Vardanyan, during
          the trial held September 27 experts, who had carried out the first and
          second medical examinations, produced their resolutions. During the
          first examination Safarov was declared sane. The second examination
          carried out with the mediation of the defense revealed elements of
          posttraumatic syndrome.

          Psychologist Yuhas Christin, who made the first examination, presented
          his viewpoint and the examination outcomes in detail. He stated that
          the people with post-traumatic syndrome can develop fear but by no
          means aggression. A person with such syndrome would never become
          an army officer and would never dare to commit a murder. Moreover,
          posttraumatic syndrome can hit people, who witnessed any tragic events,
          in part, "the events in Khodjaly," as the defense holds. However
          during the above mentioned events Safarov was in Baku and then
          left for Turkey. The attempts of expert Ildiko Kovach, who carried
          out the second examination, proved his being not professional. As
          representative of the Armenian Defense Ministry Hayk Demoyan said
          during a press conference in Budapest, Kovach insisted that when
          in Turkey Ramil Safarov took in a medicine called Xenex prescribed
          for people with posttraumatic syndrome. However Yuhas Christin said
          that such medicine was not in circulation at that time. According to
          Nazeli Vardanyan, posttraumatic syndrome is not rated as psychological
          disease and cannot be considered to be a mitigating circumstance. After
          the testimony of the experts the court decreed to hold the third
          examination to consider the previous ones and approve either of
          them. The next sitting is scheduled for December 15.

          To remind, February 19, 2004 Armenian Armed Forces lieutenant Gurgen
          Margaryan, who was taking an English course within NATO Partnership
          for Peace program was brutally hacked to death by Azeri officer
          Ramil Safarov.

          The latter was accused with Article 116.2 of the Hungarian Criminal

            Oskanian and Barsony Discussed Ongoing Legal Proceedings on Armenian Officer Murder
            Yerevan, November 18, /PanArmenian.Net/ Armenian Foreign Minister Vartan Oskanian, who is Strasbourg at present met with the State Secretary of Hungary, Andreas Barsony to discuss bilateral issues and cooperation within European structures. Minister Oskanian also referred to the ongoing trial of the Azerbaijani soldier Ramil Safarov charged with the murder of Armenian Officer Gugren Margaryan.

              Safarov will be held November 25, Safarov's attorney Adil Ismaylov
              reported. The expertise results will be presented to the Budapest court
              that will continue hearing the case December 15. In Ismaylov's words,

                Azeri Lawyer Misinterprets Verdict Of Hungarian Court

                AZERI LAWYER MISINTERPRETS VERDICT OF HUNGARIAN COURT ON EXAMINATION IN RAMIL SAFAROV CASE

                YEREVAN, NOVEMBER 24. ARMINFO. There will be no third medical
                examination of Ramil Safarov (Azeri officer killing his Armenian
                counterpart and facing criminal trial in Hungary) but a documentary
                examination of the results of the two previous examinations, says
                lawyer Nazeli Vardanyan commenting on the Azeri media report that
                there will be third examination Nov 25.

                The decision to carry out a documentary examination was made Sept 27
                because of strong contradiction between the results of the first and
                second examinations.

                Safarov is facing 10-15 years in jail. Vardanyan represents the
                interests of the family of Gurgen Margaryan, the officer Safarov
                killed, and Hayk Makuchyan, whose life he also sought.

                The next and probably the last hearing is scheduled for Dec 15.

                Safarov may also face charges of attacking Hungarian policemen.

                  YEREVAN, NOVEMBER 24, NOYAN TAPAN - ARMENIANS TODAY. A new expertise
                  on the case of Azeri serviceman Ramil Safarov accused of murdering
                  Armenian Armed Forces' Officer Gurgen Margarian will be conducted on
                  November 25 in Budapest.

                  Safarov's lawyer Adil Ismaylov informed the "Trend" agency that the
                  expertise conclusion will be publicized at the December 15 court
                  sitting.

                  The court issued no verdict on September 27 and decided to postpone the
                  sitting until December 15, because of difference in experts' opinions
                  about Ramil Safarov's mental state. Three Hungarian psychologists
                  had twice examined Safarov's psychical state before: during the first
                  examination they decided that the Azeri serviceman is sane and during
                  the second one that he couldn't completely control his actions.

                  Lawyer Nazeli Vardanian representing the interests of Gurgen
                  Margarian's legal successor at the Budapest court informed the
                  "Liberty" radio station that not an expertise on Safarov's mental state
                  will be conducted but the conclusions of two previous expertises will
                  be just confronted.
