This goes back to the way the justice system works.

If you accuse me of a murder, the burden of proof is on you to prove that I did the crime, not the other way around. I cannot prove that there is no proof. There is a logical fallacy in this way of thinking.

In any court case, those who accuse someone of the crime, are the ones that must establish certainty. In this case there is no certainty and certainly nothing to back up your assertions, thus you have no case here.
