Are you sleeping?

Makes sense no? cause logically, you CAN'T answer those questions

I can answer those too

No I am not sleeping

Makes no sense

this only works if you ask a dead guy or someone who is sleeping. But then agian you can ask a dead guy any question and he wont be able to answer

Now that I read the questions again, you can answer them, just now with a "Yes." I could be lying down on the bed with my eyes closed and someone could ask if I am sleeping, to which I say, "Nope." Similar thing with that other question. So the question of the riddle should be, "What are the two questions you can never answer with a "Yes?" It should be reworded.
