US Lawyer Seeks To Sue US Over Iran Threats

23/07/08 "Press TV" -- 22/07/08 -- Tehran -- An American lawyer has offered to represent Iran in an international lawsuit against Israel and his own government in an effort to stop Washington and Tel Aviv from initiating further sanctions against Tehran.

Francis A. Boyle says following Washington's latest ultimatum to Tehran to freeze uranium enrichment within two weeks or face further isolation, Iran needs to act quickly.

At weekend talks in Geneva, the United States delivered what it describes as a “clear and simple message” that Iran must choose between cooperation or confrontation.

In an email interview with Press TV, Boyle urged Iran to begin drafting lawsuits for presentation to the International Court of Justice (ICJ) in The Hague before the two-week ultimatum expires.

Q. Precisely what would the charges against the US and Israel be? What are you hoping to achieve?

A. About two years ago Iran contacted me about a proposal I had made to sue the United States, Israel and the EU-3 (Britain, France and Germany) at the International Court of Justice in The Hague for their repeated and public threats to launch a military attack upon Iran over its undoubted right under the Non-Proliferation Treaty (NPT) to engage in nuclear reprocessing.

My proposal was that Iran should sue these states immediately, convene an Emergency Hearing by the World Court, and ask the Court to indicate provisional measures of protection on behalf of Iran against the United States, Israel and the EU-3 -- basically a temporary restraining order.

I felt that these lawsuits would be able to prevent a military attack against Iran and also prevent the imposition of sanctions against Iran by the United Nations Security Council. In addition, by Iran submitting this entire matter to the World Court, it would make it clear to the entire world who the real culprits are here.

The threat and use of military force clearly violates Article 2(4) of the United Nations Charter. The Charter also mandates the peaceful resolution of international disputes. By filing these lawsuits Iran would prove to the entire world that it intends to resolve this matter peacefully and in accordance with international law.

I notice that just this week Iran's Supreme Leader Ayatollah Seyyed Ali Khamenei publicly stated that he would sue the United States if it attacked Iran. I am proposing that we sue the United States immediately in order to prevent any attack upon or blockade of Iran, which would be an act of war.

Q. Why are you seeing to bring this action in an international court, rather than a domestic US court?

A. This would be a total waste of time. Based upon my prior experience, there is no way a United States court would rule against the United States government on a matter like this.

Q. You are proposing to represent Iran in a court action against the US and Israel - what are you seeking from Tehran - what mandate would they need to give you. Basically, how would this work?

A. Of course if Iran wants me to represent Iran in these lawsuits I would be happy to do so. But given the fact that I am a US national, Iran might prefer to have its own lawyers file these lawsuits. Iran already has a detailed Memorandum of Law from me on these lawsuits. The Iranian lawyers can simply use my Memorandum as they see fit. I would be happy to assist them in whatever way they desire.

Q. The International Criminal Court (ICC) has been in the news recently regarding a prosecution against Sudan's leader, Omar al-Bashir. Explain the difference between the ICJ and the ICC.

A. The International Court of Justice deals with disputes between states, which the nuclear reprocessing dispute is all about. The International Criminal Court deals with the personal criminal responsibility of individuals. It has no authority to rule upon or settle disputes between states, which the ICJ can do.

Q. The US does not recognize the jurisdiction of the ICC - what is its relationship with the ICJ?

Well, here are the facts:

In fact, the Clinton Administration's NATO war against Yugoslavia probably cost more lives than were lost in the civil war in Kosovo. Serbian troops were forced to withdraw in exchange for an international guarantee that Serbia would retain sovereignty over Kosovo but the province would get substantial autonomy. The U.S. agreed to that, but that agreement was violated when the Bush Administration, with backing from McCain and Democratic presidential candidates Hillary Clinton and Barack Obama, recently recognized Kosovo's declaration of independence from Serbia.

WASHINGTON - John McCain's chief foreign policy adviser and his business partner lobbied the senator or his staff on 49 occasions in a 3 1/2-year span while being paid hundreds of thousands of dollars by the government of the former Soviet republic of Georgia.

The payments raise ethical questions about the intersection of Randy Scheunemann's personal financial interests and his advice to the Republican presidential candidate who is seizing on Russian aggression in Georgia as a campaign issue.

McCain warned Russian leaders Tuesday that their assault in Georgia risks "the benefits they enjoy from being part of the civilized world."

On April 17, a month and a half after Scheunemann stopped working for Georgia, his partner signed a $200,000 agreement with the Georgian government. The deal added to an arrangement that brought in more than $800,000 to the two-man firm from 2004 to mid-2007.

For the duration of the campaign, Scheunemann is taking a leave of absence from the firm.

"Scheunemann's work as a lobbyist poses valid questions about McCain's judgment in choosing someone who — and whose firm — are paid to promote the interests of other nations," said New York University law professor Stephen Gillers. "So one must ask whether McCain is getting disinterested advice, at least when the issues concern those nations."
"If McCain wants advice from someone whose private interests as a once and future lobbyist may affect the objectivity of the advice, that's his choice to make."

McCain has been to Georgia three times since 1997 and "this is an issue that he has been involved with for well over a decade," said McCain campaign spokesman Brian Rogers.

McCain's strong condemnation in recent days of Russia's military action against Georgia as "totally, absolutely unacceptable" reflects long-standing ties between McCain and hardline conservatives such as Scheunemann, an aide in the 1990s to then-Senate Majority Leader Trent Lott.
Scheunemann, who also was a foreign policy adviser in McCain's 2000 presidential campaign, has for years traveled the same road as McCain in pushing for regime change in Iraq and promoting NATO membership for Georgia and other former Soviet republics.


After contacts with McCain's staff, the senator introduced a resolution saluting the people of Georgia on the first anniversary of the Rose Revolution that brought Mikhail Saakashvili to power.

Four months ago, on the same day that Scheunemann's partner signed the latest $200,000 agreement with Georgia, McCain spoke with Saakashvili by phone. The senator then issued a strong statement saying that "we must not allow Russia to believe it has a free hand to engage in policies that undermine Georgian sovereignty."

Rogers, the McCain campaign spokesman, said the call took place at the request of the embassy of Georgia. And McCain campaign spokeswoman Nicolle Wallace added that the senator has full confidence in Scheunemann. "We're proud of anyone who has worked on the side of angels in fledgling democracies," she said in an interview.
McCain called Saakashvili again on Tuesday. "I told him that I know I speak for every American when I said to him, today, we are all Georgians," McCain told a cheering crowd in York, Pa. McCain's Democratic rival, Barack Obama, had spoken with Saakashvili the day before.

In 2005 and 2006, McCain signed onto a resolution expressing support for the withdrawal of Russian troops from Georgia; introduced a resolution expressing support for a peace plan for Georgia's breakaway province of Ossetia; and co-sponsored a measure supporting admission of four nations including Georgia into NATO.
On Tuesday, McCain told Fox News that "as you know, through the NATO membership, ... if a member nation is attacked, it is viewed as an attack on all."
Scheunemann's lobbying firm is one of three that he has operated since 1999, with clients including BP Amoco, defense contractor Lockheed Martin Corp. and the National Rifle Association.
Scheunemann is part of the community of neoconservatives who relentlessly pushed for war in Iraq.

No one in Washington is more closely aligned with the Bush administration's decision to invade Iraq than prominent neoconservatives, who for years had regime change in Iraq as a goal as part of their philosophy that the United States shouldn't be reluctant to use its power, both diplomatic and military, to spread democracy and to guarantee world order.
Now, McCain and other politicians who pushed for the invasion are seeking to emphasize the progress, albeit fragile, of the current troop surge in Iraq.
In the months before the war began, Scheuenemann ran the Committee for the Liberation of Iraq, set up in November 2002 when public support for the looming invasion was eroding.

'Timing of missile deal betrays US intent'

Russia says the timing of a controversial US-Poland deal to base a missile defense shield in Europe betrays Washington's true intention.

Russia's NATO envoy told Reuters on Friday that The US has shown that Russia is the true target of its planned missile defense shield by signing a deal with Poland during an international crisis over Georgia.

"The fact that this was signed in a period of very difficult crisis in the relations between Russia and the United States over the situation in Georgia shows that, of course, the missile defense system will be deployed not against Iran but against the strategic potential of Russia," Dmitry Rogozin said in a telephone interview.

The remarks were made a day after Washington and Warsaw signed the deal to base ten missile interceptors in the country.
Polish Prime Minister Donald Tusk said Thursday that the deal has been reached after more than eighteen months of negotiations between the two countries.
