Forum Rules (Everyone Must Read!!!)

1] What you CAN NOT post.

You agree, through your use of this service, that you will not use this forum to post any material which is:
- abusive
- vulgar
- hateful
- harassing
- personal attacks
- obscene

You also may not:
- post images that are too large (max is 500*500px)
- post any copyrighted material unless the copyright is owned by you or cited properly.
- post in UPPER CASE, which is considered yelling
- post messages which insult the Armenians, Armenian culture, traditions, etc
- post racist or other intentionally insensitive material that insults or attacks another culture (including Turks)

The Ankap thread is excluded from the strict rules because that place is more relaxed and you can vent and engage in light insults and humor. Notice it's not a blank ticket, but just a place to vent. If you go into the Ankap thread, you enter at your own risk of being clowned on.
What you PROBABLY SHOULD NOT post...
Do not post information that you will regret putting out in public. This site comes up on Google, is cached, and all of that, so be aware of that as you post. Do not ask the staff to go through and delete things that you regret making available on the web for all to see because we will not do it. Think before you post!


2] Use descriptive subject lines & research your post. This means use the SEARCH.

This reduces the chances of double-posting and it also makes it easier for people to see what they do/don't want to read. Using the search function will identify existing threads on the topic so we do not have multiple threads on the same topic.

3] Keep the focus.

Each forum has a focus on a certain topic. Questions outside the scope of a certain forum will either be moved to the appropriate forum, closed, or simply be deleted. Please post your topic in the most appropriate forum. Users that keep doing this will be warned, then banned.

4] Behave as you would in a public location.

This forum is no different than a public place. Behave yourself and act like a decent human being (i.e. be respectful). If you're unable to do so, you're not welcome here and will be made to leave.

5] Respect the authority of moderators/admins.

Public discussions of moderator/admin actions are not allowed on the forum. It is also prohibited to protest moderator actions in titles, avatars, and signatures. If you don't like something that a moderator did, PM or email the moderator and try your best to resolve the problem or difference in private.

    Just Got My First Speeding Ticket.. Got a Couple Questions

    Well, to start off, I'm usually never the one to speed. I'm always driving cool, at a reasonable speed. Today, my friends and I decided to go fishing, so I was going to my cousins house at 8:30 in the morning.

    As I exit the freeway, I get on a really wide street with absolutely NO cars on it. I press on the gas, and I guess I didn't realize how fast I was going. All of a sudden, I notice a cop was standing OUTSIDE his car, and he got into the middle of the street and put his arms up. I hit the brakes, but by the time my car stopped, I was pretty far from him. He signaled me to reverse, so I did. He walked up to my car and asked for my license and proof of insurance. He also showed me his radar gun and it said 79. I was doing 79 in a 35 MPH zone, lol. I didn't even NOTICE I was going that fast.

    Ok, so he took my license and insurance, and he went to his car, and he's already starting to write the ticket. No point in asking him to let me go. He came back, told me I was doing freeway speed so he felt like he had to write me a ticket. I told him I understood and he gave me my stuff back.

    He told me to not even bother going to court, and to just take traffic school and pay my fine. Now here's where my questions kick in..

    How much would the fine be exactly? I did 79 in a 35 zone. I live in California, if that matters. I heard it's $11 for every mile you go over, so $11 x 44 would be $484? Is that the actual price?

    Also, a bunch of people told me to keep extending the court date, go to court and try to fight it - and he might not even show up. I heard if the cop doesn't show up, they drop the fines and you don't pay? Is this true, because a few people told me it's happened to them, but my cousin says he went to court and the cop didn't show up, but he still had to pay. What's the deal with this fighting issue?

    Another thing is, on my ticket the cop wrote "Chase Down" under Code/Description. Meaning, he chased me down? What the xxxx, he was standing outside his car - he didn't even run or anything. Can't I bring this up in court when I try to fight it, if he does show up, to back my story up?

    Let's say he does show up, can I bring up the "chase down" and prove he didn't chase me at all, proving he lied? Then I could also say there's no way I was going 79 'cause the street I got pulled over on is ALWAYS traffic, but for some reason, it wasn't today. So I could just say there's no way I could do 79 on that street in the morning, because it's usually rush hour.

    A lot of people told me they got away with saying xxxx like that, but I just wanna know - how much is the fine if I went 44 miles over and if he doesn't show up in court, does it get dropped?

    I also read stories online about how people had to pay $300-$800 for the ticket, including 1-3 points on their lisense, AND/OR suspension of the license. How can I find out for sure what I'm facing?

    In New York, if you show up to court, AT ALL, EVER, you dont have to pay the fine. And New York cops never show up to court. I guess they say if your queer enough to show up to court, you must be desperate, so they let you go.

      It's definitely in the hundreds. It's been a while since I got a speeding ticket but I remember it was a hefty price, ranging in the hundreds. It shouldn't be more than 400 though.

          I'm expecting it to be in the 500's. I just need to know about the rest. No one knows for sure, it's making me so mad. Lol. Everyone's telling me something different.

            He actually wrote down 79 in a 35? Dang, what a xxxx. You had the courtesy to stop and not pretend like you didn't see him, least he can do is write 45 or 50 in a 35. Your best bet is to ask a lawyer, but from my understanding, you must plead not guilty or no contest in order to have your ticket dismissed (if the cop doesn't show up.) The catch 22 is you plead before actually going to court, meaning if you plead not guilty, you have to have a good argument incase the cop does show up, and in these cases, the judge is less willing to give you traffic school. However, I'm not 100% sure on when you actually plead, but this is my understanding. Should help you connect the dots.

              Thanks. I just spoke to my cousin.

              In the end, I might just pay and take traffic school. Going to court and getting it dismissed does sound good, but chances are it might not work out. With my luck, the cop will show up, I'll lose - get a point, no traffic school, and my insurance will rise.

              I'll try to save up money, somehow. I'm still waiting on a job interview to call me back.

                They usually keep notes in case they do have to go to court and if he sees that you are fighting it, he may make it a point to go. Who knows *shrug*. You were going waaaay over the limit, so I don't know how you're gonna fight it. If it was close and he didn't have it on radar, you'd have a shot maybe saying that he misjudged, but radar and 40+ over, sounds like a long shot.

                If you decide to go the traffic school route, do it online for sure if it's an option for that court because it takes only an hour, it's really easy, and they send the proof to the court for you. I've done it twice, once for me and once for a friend (soon after mine and I still remembered the questions).

                There's also a book called How to Fight Your Ticket and Win in California (or something to that effect). Maybe go by a bookstore and look through it. ;-)

                  You might want to double check this with the court but you can go to court, and see if the guy shows up or not. If he shows up, before you go in front of the judge, ask for traffic school from the clerk. I know this used to work several years ago but I'm not sure if it's allowed anymore ... I guess it'll also depend on the court. There are also many websites with various letters that you can take and send to try to fight a ticket without going to court.

                  But if he has you on radar, you have to the following courses of action:

                  1. He doesn't show up and the ticket is dismissed
                  2. You ask for the radar calibration papers and they are more than 6 months old (from the date of the ticket) and the ticket is dimissed
                  3. You can make a reasonable case that you were speeding safely.. I doubt any judge is going to go for 79 in a 35 being safe but there are times when you can make a valid case for it.
                  4. You pay the ticket, go to "online" traffic school (basically a joke) and try not to speed again. This is the easiest and best option for not having it go on your record and screw up your insurance.

                  There may be other options and these might be wrong so add me to your list of "everyone says something different" One reason for all this is because the laws and rules change and they also seem to vary from court to court.

                    I know, but his "chase down" thing is not true, plus he told me "don't go to court, just pay the ticket and go to traffic school". Kinda shows that he doesn't wanna show up to court himself.

                    I've also done traffic school for 20+ people, and I can do them in 15 minutes or less, lol. That parts not a problem, but the $500 ticket is.

                    I'm probably gonna pay anyway.
