Well, to start off, I'm usually never the one to speed. I'm always driving cool, at a reasonable speed. Today, my friends and I decided to go fishing, so I was going to my cousins house at 8:30 in the morning.
As I exit the freeway, I get on a really wide street with absolutely NO cars on it. I press on the gas, and I guess I didn't realize how fast I was going. All of a sudden, I notice a cop was standing OUTSIDE his car, and he got into the middle of the street and put his arms up. I hit the brakes, but by the time my car stopped, I was pretty far from him. He signaled me to reverse, so I did. He walked up to my car and asked for my license and proof of insurance. He also showed me his radar gun and it said 79. I was doing 79 in a 35 MPH zone, lol. I didn't even NOTICE I was going that fast.
Ok, so he took my license and insurance, and he went to his car, and he's already starting to write the ticket. No point in asking him to let me go. He came back, told me I was doing freeway speed so he felt like he had to write me a ticket. I told him I understood and he gave me my stuff back.
He told me to not even bother going to court, and to just take traffic school and pay my fine. Now here's where my questions kick in..
How much would the fine be exactly? I did 79 in a 35 zone. I live in California, if that matters. I heard it's $11 for every mile you go over, so $11 x 44 would be $484? Is that the actual price?
Also, a bunch of people told me to keep extending the court date, go to court and try to fight it - and he might not even show up. I heard if the cop doesn't show up, they drop the fines and you don't pay? Is this true, because a few people told me it's happened to them, but my cousin says he went to court and the cop didn't show up, but he still had to pay. What's the deal with this fighting issue?
Another thing is, on my ticket the cop wrote "Chase Down" under Code/Description. Meaning, he chased me down? What the xxxx, he was standing outside his car - he didn't even run or anything. Can't I bring this up in court when I try to fight it, if he does show up, to back my story up?
Let's say he does show up, can I bring up the "chase down" and prove he didn't chase me at all, proving he lied? Then I could also say there's no way I was going 79 'cause the street I got pulled over on is ALWAYS traffic, but for some reason, it wasn't today. So I could just say there's no way I could do 79 on that street in the morning, because it's usually rush hour.
A lot of people told me they got away with saying xxxx like that, but I just wanna know - how much is the fine if I went 44 miles over and if he doesn't show up in court, does it get dropped?
I also read stories online about how people had to pay $300-$800 for the ticket, including 1-3 points on their lisense, AND/OR suspension of the license. How can I find out for sure what I'm facing?
